Data Security and Protection Lead (Information Governance)
Our Data Security and Protection Lead will provide Torbay and South Devon NHS Foundation Trust (the Trust) with strategic leadership and guidance, to ensure that the Trust complies with the requirements included in the National Programme of Information Governance. This includes the General Data Protection Regulations (GDPR), Data Protection Act 2018, Freedom of Information Act 2000, Caldicott Guidelines and Corporate Record Management.
This role will be a prime source of expert advice and policy development for the General Data Protection Regulations to create and maintain high level awareness, profile and understanding of the strategic and practical importance of Data Protection, and to assure the Trust Board that it is meeting its statutory and legal obligations.
The Trust Board and senior management team is committed to ensuring high standards of Data Protection across and is a key driver of the Trust's ability to deliver excellence in all aspects of patient care
Main duties of the job
o Provide advice, guidance and reporting of Data Protection to the Trust board and its Executiveso Provide guidance and support to staff and patients regarding confidentiality and security issueso Develop internal guidelines and protocols on sharing patient-identifiableinformation within TSDFT and outside agencies as required by the terms ofthe Data Protection Act 18 and by doing so, supporting of the CaldicottGuardian in his role as Protector of Patient Informationo Provide and issue guidance in conjunction with the Caldicott Guardian for staff about appropriately seeking consent from individuals when personalinformation is to be used in ways that does not directly contribute to their careo Laise with the Caldicott Guardian regarding requests for information, data breaches or access rights/sharing of informationo Deputise for the Caldicott Guardian in their absence, and to provide support for Caldicott specific reportingo Oversee the administration of Data Protection Subject Access Requests by the Data Access & Disclosure staff, within the designated timeframe. This involves a procedure laid down by the Department of Health and the Trust's own procedureso Review the Trust's notification and amend/renew our registration with the Information Commissioner as required by the Data Protection Act 1998, and the GDPR

Qualifications and Experience
Essential
- oEducated to degree level or equivalent specialist experience in Data Protection, Freedom of Information, and the General Data Protection Regulations
- oExperience of Information Governance
- oComprehensive understanding of the General Data Protection Regulations, Data Protection Act 1998 & Freedom of Information Act 2000, EIR, Caldicott Reports, and corporate record management.
- oUnderstanding of the NHS Records Management Code of Practice and the DSPToolkit.
- oMinimum 5 years' experience in Information governance or related field.
Desirable
- oPractitioner Certificate in Data Protection
- oPractitioner Certificate in Freedom of Information
- oUnderstanding of the Human Rights Act 1998, Crime & Disorder Act 1998.
- oUnderstanding of legal issues surrounding the Woolf Report (pre-action disclosure) for personal injury claims
- oSeveral years' experience of implementing or managing Data Protection/ FOI and Records Management in an organisation.
