The Information Rights Team Leader, based within the Information Governance team, will support the Trust to provide a coherent approach to Information Assurance and Compliance and will process information rights requests for both service users and staff ensuring compliance with statutory frameworks and timeframes including but not limited to Data Protection Act 2018/ UK GDPR, Access to Health Records Act 1990 and Freedom of information Act 2000.

To ensure the Trust's regulatory and statutory obligations are being met in relation to internal Policies and Procedures and Data Protection Act 2018, UK GDPR, and Caldicott Principles.

This role requires an individual who can multitask and provides an efficient service under pressure requiring concentration in varying depths depending on the task or situation at hand.

This post requires skills to deal with complex, upsetting and sensitive information recorded in service user records, often dealing with bereaved relatives. There is a need to be particularly cautious managing sensitive information around serious crime when liaising with the police.

Main duties of the job

The post holder will operationally manage requests coming into the Trust for information held, under the Data Protection Act 2018, Freedom of Information Act 2000 and associated legislation.

Support the Information Governance Manager in the delivery of an effective Information Assurance, Governance and Compliance service carrying out tasks and maintaining responsibilities in relation to:
  • FOI & Data Protection inc SAR's
  • Disclosure Advice & Support
  • Training & Education compliance

Job description

Job responsibilities

The post holder will:
  • Lead the Information Rights team ensuring compliance with statutory deadlines through the effective management of the case management system and formation of standardised operational processes.
  • Ensure that they are familiar with all access to information requests coming in to the organisation and monitor trends and issues working to resolve them or escalate where appropriate.
  • Be responsible for Access to Records requests (SAR, FOI, and other related requests), ensuring they are delivered efficiently and effectively in line with Statutory requirements and national standards.
  • Ensure systems and processes are in place and operational so that requests can be extracted and responded to within the statutory time frame - this will include assisting with complex access to information requests (SAR, FOI) ensuring the public interest process takes place.
  • Be the first point of contact for complaints relating to access to information requests. This will involve reviewing a response and providing a decision to the requestor. Where required the post holder will support the Information Governance Manager in dealing with complex complaints involving the Information Commissioners Office.
  • Line manage the Information Governance Assistant(s) and their work encompassing Freedom of Information, Subject Access to Records, Individuals Rights Requests, Records Management and all Information Governance / Data Protection matters.
  • Support the development of policies and documents in line with legislation ensuring the Trust always remains compliant and up to date.
  • Prepare analysis reports of performance statistics to identify trends and areas for action and improvement and provide regular reports to Senior Management colleagues and committees.
  • Monitor and review completed disclosures under the Data Protection Act to ensure they observe all legislative requirements, and the relevant staff adhere to departmental policies and procedures.
  • Lead on the management of the Trusts Freedom of Information Publication Scheme and FOI Disclosure Log, ensuring appropriate systems are in place to maintain its accuracy and completeness, including negotiating with stakeholders and senior staff, as well as judging the appropriate level of content and detail.
  • Provide advice and training in relation to data subject/ information rights legislation and confidentiality good practice.
  • Support the Information Governance Manager with the management of appeals, internal reviews and complaints, liaising with the Information Commissioners Office.
  • Work flexibly to ensure that all information requests that are received by the Trust are processed lawfully. This will include liaising with other teams and departments and accessing health information in whichever media it is held.
  • Be required to liaise with the management team regarding information requests which are likely to breach the statutory timescale, to provide relevant information to as to the cause and to consider solutions.
  • Foster good working relationships with colleagues and where necessary arrange meetings with Clinicians or their secretaries, or Trust FOI Leads to ensure that it is appropriate to disclose information.
  • Participate in IG related meetings with partner organisations in Health and Social Care related sectors.
  • Be responsive to the needs of the customers of the Information Governance Department at all times and provide them with a high quality and efficient service.
  • Participate in department development as appropriate and to participate in departmental meetings.
  • Strictly adhere to all departmental policies with regards to processing requests for information.
  • Ensure compliance with all relevant Trust policies and provide assurance on IG standards through audits
  • Provide a point of contact for enquiries, handling incoming/ outgoing communications/ sensitive data/ issues from Senior Managers, staff and other organisations with empathy and in a confidential manner.
  • Provide first line support and management to teams within the service as appropriate.
  • Work on tasks that support the trust to achieve Data Security and Protection Toolkit (DSPT/CAF) compliance.
  • Undertake any other duties and tasks as may be required, appropriate to the level of the role.

Person Specification

Knowledge and Skills


  • Ability to work to tight deadlines and meet targets
  • Excellent understanding of the Data Protection Act 2018 Information Rights and Freedom of Information Act 2000
  • Proven effective communication skills both verbally and written with attention to detail.
  • Proven use of office systems, with advanced use of Microsoft Office, i.e. MS Word, PowerPoint, Outlook and Excel
  • Excellent planning and organisational skills
  • Excellent facilitation, influencing and conflict resolution skills
  • Ability to work under pressure to a high standard of output

Training and Qualifications


  • Educated to Degree Level or equivalent relevant experience
  • GCSE or equivalent in English & Maths
  • Ability and willingness to undertake additional personal training relevant to role.


  • Management qualification
  • Project Management qualification such as Prince 2 or equivalent
  • Formal Recognised Qualifications (ISEB or equivalent) in Data Protection and/or Freedom of Information.



  • A minimum of 3 years working in a complex Information Governance environment
  • Experience in managing staff - including performance management, managing sickness absence and disciplinary issues, managing resource and financial budgets.
  • Experience of working within a public sector setting
  • Experience of processing FOI Requests and associated Internal Reviews/completion of Public interest Tests
  • Experience of Subject Access Request processing under the Data Protection Act 2018.
  • Provision of subject matter advice to the wider Trust/organisation
  • Team working
  • Experience of working with Health Records and knowledge & understanding of current records management guidance
