Manage the defence of all personal injury claims against the Trust ensuring that each claim is fully investigated.

Acknowledge and correspond with claimant solicitors, litigants in person and any other relevant party, via letter, telephone and email.

Undertake the investigation to ensure that all relevant statements, documentation, evidence and any other information relevant to the claim has been obtained, including taking witness statements from staff, as required.

Main duties of the job

1.1. Liaise with the NHS Resolution, claimant and defendant solicitors, and advise on the acceptance of settlements and procedure under the supervision of the Inquest and Claims Manager

1.2. Complete the LPTS form and NHS Resolution paperwork and send this to NHS Resolution. Liaising with case managers.

1.3. Help ensure that the number of claims is reduced by reporting the appropriate learning and developing systems interlinking governance and risk management.

1.4. Attend conferences and court on these matters and take a full note of proceedings

Job responsibilities

Legal research and interpretation: to have the appropriate training and ability to research law accurately and efficiently using the internet, journals or textbooks, as appropriate. To identify the relevant pieces of statute and case law and interpret that information for the benefit of the Trust solicitors or non-legal trained individuals and brief such employees of the Trust in terms of content, meaning, implications and required actions.

Court Work: to assist members of staff who are required to attend Court by reason of their employment. To have knowledge and insight into the running of the court and court process for civil or criminal courts, as required, and to ensure that members of staff are fully informed and prepared for their court appearances by explaining what they should expect and what will be expected of them. To support the employee throughout the experience by interpreting procedure as required whilst acting in a professional and tactful manner throughout. To attend court and make a full attendance note where the proceedings are of interest to the Trust.

Assistance to Trust solicitors: to include, but not limited to, contentious inquests, research and claims management.

Person Specification

Qualifications

Essential

  • GCSE grade A-C in English and Maths
  • Law degree or conversion course
  • Post graduate diploma in legal practise or equivalent experience
  • Awareness of NHS resolution guidelines
  • Knowledge of Inquests/Coroner's rules
  • Knowledge if the Court process


Experience

Essential

  • Practical experience of managing a caseload of personal injury/ inquest claims in a law firm or working in-house.
  • Preliminary Analysis
  • Report writing
  • NHS experience


Desirable

  • Experience off attending inquests


Communication skills

Essential

  • Excellent written and oral communication skills for court and
  • written legal documentation and presentation.
  • Ability to communicate sensitive, complex and contentious messages in a highly charged situation doing so with empathy, compassion and confidence
